Shanghai International Energy Exchange Application Guidelines for Non-Display Use of Level-2 Market Data in Designated Server Rooms
“Non-display use of level-2 market data in designated server rooms” (“Non-Display Use”) refers to the arrangement in which the Shanghai International Energy Exchange (INE) licenses a Member to receive level-2 market data in designated server rooms for non-display use by the Member itself or by its Clients.
I. Eligible Users
Non-Display Use is available to futures firms and other institutions that maintain colocation equipment in the designated server rooms and their clients.
II. Permitted Usage
(I) Self-use: Futures firms are licensed to use non-display data, including for optimizing their client transaction monitoring and surveillance system, within their own application systems in designated server rooms.
(II) Client use: In addition to self-use, futures firms are additionally licensed to permit the use of data by their signing clients within the application systems the clients have deployed in the same server room.
III. Commercial Terms
The commercial terms are detailed in the corresponding fee schedule.
The fee items and rates are subject to change by INE in view of the circumstances.
IV. Application Procedures
(I) Line access; market data account opening, update, and closure; and termination of line access by futures firms
1. Line access and account opening
A futures firm that is a first-time applicant for Non-Display Use should submit the following to INE: An application letter (affixed with its common seal or “sealed” hereinafter), Line Application Form (sealed), Account Application Form for Non-Display Use of Level-2 Market Data (Member Only) (sealed), photocopy of the ID card of the applicant’s legal representative or authorized representative (sealed), and other materials required by INE.
Once the application is approved, INE will enter into the INE License Agreement for Non-Display Use of Level-2 Market Data and Line Service Agreement (collectively, “Agreements”) with the applicant, and complete line access and account opening procedures accordingly.
2. Information update
A futures firm that intends to change its contact person, account information, the server room for data access, subscription, system name, purpose of use, equipment, and other information on file should submit to INE the Update Form for Non-Display Use of Level-2 Market Data (Member Only) (sealed). Such change will take effect following INE’s review.
3. Account closure
A futures firm that intends to close its Non-Display Use account should submit to INE the Account Closure Form for Non-Display Use of Level-2 Market Data (Member Only) (sealed). The account will be closed following INE’s review.
4. Termination of line access
A futures firm may terminate its line access only after it has closed all market data accounts. To terminate the access, it should submit the Line Termination Form (sealed). The access will be terminated following INE’s review.
(II) Opening, update, and termination of client market use accounts
Account opening, update, and closure for Non-Public Use for clients of futures firms and other institutions should be handled by the futures firms and institutions on their behalf. INE does not provide additional support for data access by clients.
1. Account opening
Futures firms and the other institutions should enter into the Agreement on Use of Level-2 Market Data of Shanghai International Energy Exchange with their clients and submit the Account Application Form for Non-Display Use of Level-2 Market Data (Client Only) (sealed) to INE. The account will be opened following INE’s review.
2. Information update
In the event of a change to a client’s account information, the server room for data access, subscription, system name, purpose of use, equipment, and other information on file, its carrying futures firm should submit on its behalf the Update Form for Non-Display Use of Level-2 Market Data (Client Only) (sealed). Such change will take effect following INE’s review.
3. Account closure
If a client intends to close its Non-Display Use account, its carrying futures firm should submit on its behalf the Account Closure Form for Non-Display Use of Level-2 Market Data (Client Only) (sealed). The account will be closed following INE’s review.
V. Reporting on Market Data Users and Fee Payment
Futures firms and the other institutions should, in accordance with the terms of the Agreements, submit to INE the statistical forms on the market data users and pay the line service fee, license fee, and user fee.
